What information do we collect?

How do we protect your information? 

We implement a variety of security measures to maintain the safety of your personal information when you submit a request, place an order or access your personal information.

All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

After a transaction, your private information (credit cards, social security numbers, financials, etc.) will be kept on file in order to store data only

Because we store credit card information on our own servers, we have taken appropriate measures to ensure that we are PCI DSS Compliant..

Do we use cookies?

As part of the California Online Privacy Protection Act, all users of our site may make any changes to their information at anytime by logging into their trade platform members control panel and going to the 'Edit Profile' page.

Childrens Online Privacy Protection Act Compliance 

We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older.

CAN-SPAM Compliance 

We have taken the necessary steps to ensure that we are compliant with the CAN-SPAM Act of 2003 by never sending out misleading information.

Agreement and General Terms of Use

The Ban Exchange reserves the right, in its sole discretion, to change any or all of the provisions of this Agreement at any time. The Agreement in effect at the time of your use of the Service shall govern your use and your use of the Service after the effective date of any changes to this Agreement will be deemed your acceptance of the changes. The Ban Exchange reserves the right, in its sole discretion, to change, limit, or discontinue any aspect, content, tool, or feature that is a part of the Services. The Ban Exchange further reserves the right, in its sole discretion, to restrict the use of the Service as well as suspend or revoke your rights to use the Services based on The Ban Exchange's belief that your use of the Services violates that permitted by this Agreement or applicable law. 
  
IF YOU DO NOT AGREE TO THE PROVISIONS OF THIS AGREEMENT OR ARE NOT SATISFIED WITH THE SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE OF THE SERVICES. A AUTOMATED CANCEL ACCOUNT SERVICE, IS WITHIN EACH LOGIN ACCESS. 


Registration, Fees and Payments, Free Trial Use 

As part of the registration process, you will be required to select a password and username. The Ban Exchange may refuse to grant you a username that impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, is vulgar or otherwise offensive, or may cause confusion as determined by The Ban Exchange in its sole discretion. You will be responsible for the confidentiality and use of your username and password and agree not to transfer or resell you use of or access to the Service to any third-party. If you have reason to believe that your account with The Ban Exchange is no longer secure, you must immediately notify The Ban Exchange of the problem by contacting The Ban Exchange using this form http://www.ibm.com/support/operations/worldwide/  and you must request that your password be changed with IBM. YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND ENTIRELY RESPONSIBLE FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH YOUR ACCOUNT. 
  
If you become a paid member ("trader, traders, PCH, PCH's, SSCH, PhD’s, subscriber, subscribers, member, members,") of any of the Services, you will be bound by the payment terms set forth herein. 
  
Except as set forth herein or as described by offers we make from time to time, access to the entire "AUTOMATED TRADE SCRIPTS" Service requires payment. Rates vary. If you subscribe, you must provide accurate, complete and updated subscriber information with IBM. You will pay The Ban Exchange for all fees, charges, and any applicable taxes, associated with the Services in accordance with the current rates, payment terms, and policies specified by The Ban Exchange in the applicable Service enrollment screens and online help areas. You acknowledge that you will pay The Ban Exchange all such fees, charges, and applicable taxes for the Services where enrollment in the Services has been made using your credit card or other means, whether made by you personally or by someone else in your household or organization on your behalf. If you enroll in the Services using a credit card, you certify to The Ban Exchange that you are at least 18 years of age and that you are the cardholder of the credit card, or that you are certifiably at least 13 years of age and expressly authorized by the cardholder, and The Ban Exchange corporate body, to enroll in the Services. 
  
You further acknowledge that your obligation to pay The Ban Exchange all such fees, charges, and applicable taxes for the Service does not depend on usage of the Service, and that you remain obligated to pay The Ban Exchange for the Service regardless of whether the Service is successfully used or not. Unless you enroll as part of a free trial, your obligation to pay for the Service begins on the date of your capitalization/incomes/revenues in the Service, not the date of your first use of the Service. Always available, are free trial or free access periods to use the Service also begin on the date of your enrollment in the free trial for the Service, and not the date of your first use of it. 
  
You may cancel your monthly or yearly account for the Service during any free trial or free access period without charge. You may also cancel any subscription for the Service at any other time during its term. However, The Ban Exchange does not prorate any fees, charges, or an applicable tax associated with the Service upon any termination or cancellation and does not refund any such amounts for any term already charged. You may cancel your account for the Service by completing and submitting a cancellation form at http://www.ibm.com/support/operations/worldwide/ or calling the customer service number located in the customer service area of the Services. A AUTOMATED CANCEL ACCOUNT SERVICE, IS WITHIN EACH LOGIN ACCESS. We strongly recommend that you use the cancellation form as telephone calls are accepted only during business hours and may result in delays of cancellation. General emails not utilizing the above-mentioned form, letters and other means of notification, including notifying your Credit Card Company or bank that you no longer wish to be a subscriber will not serve as valid means of cancellation. In the event that you no longer have access to the online cancellation form or a telephone, you may send a certified letter, return receipt requested to IBM and your cancellation will be effective upon actual receipt by IBM. 
  
The price you pay for a Service is stipulated at the time you enroll in such Service and is valid for the initial period for which you enrolled in the Service. The Ban Exchange reserves the right to change the price paid for a monthly or annual subscription/dues after the initial enrollment period. MONTHLY AND YEARLY SUBSCRIPTIONS/DUES TO THE SERVICE ARE ON A CONTINUOUS RENEWAL BASIS. This means your subscription/dues will automatically renew every year, and/or the time period you activate; for annual subscriptions, this means every year on your annual enrollment anniversary. Your credit charge or other form of payment will be automatically charged or debited unless you have notified The Ban Exchange in accordance with the Section above hereof that you wish to cancel the Service. Your subscription renewal will be at the then current price charged for the Service or your enrollment price, whichever is higher. YOU MUST CANCEL BEFORE YOUR SUBSCRIPTION RENEWAL DATE TO AVOID CONTINUED CHARGES. 
  
If you obtained your subscription/dues through a corporate subscription or other promotional code (s), service (s), you must comply with the terms of that subscription. You agree not to disclose your promotional code, service, to other persons. The Ban Exchange reserves the right to cancel a subscription redeemed through a corporate subscription or other promotional code (s) if we determine that the user of the promotional code, services, was not the intended recipient of that code, service. We also reserve the right to seek compensation from individuals who share or disseminate their promotion codes, or other, contrary to this policy. 
  
Except with respect to payment terms when a trial is cancelled prior to its termination, this Agreement also states the terms and conditions under which you, as an evaluating user, shall be governed during any free trial period offered by The Ban Exchange. 


Disclaimer of Warranties & Limitation of Liability 

YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. NEITHER The Ban Exchange NOR ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS) WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THEY WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, OR AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, OR CONTENTS OF ANY CONTENT, INFORMATION, MATERIAL, POSTINGS, OR POSTING RESPONSES FOUND ON THE SERVICE, ANY MERCHANDISE OR SERVICES PROVIDED THROUGH THE SERVICES, OR ANY LINKS TO OTHER SITES OR SERVICES MADE AVAILABLE ON/IN THE SERVICES. 
  
THE SERVICES, ALL TOOLS, CONTENT, MATERIAL, INFORMATION, POSTINGS, OR POSTING RESPONSES FOUND ON THE SERVICE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 
  
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR GROSS OR WILLFUL NEGLIGENCE, SHALL The Ban Exchange (OR ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS), BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, ANY CONTENT, INFORMATION, MATERIAL, POSTINGS, OR POSTING RESPONSES ON THE SERVICE, OR THE SERVICE ITSELF. THESE LIMITATIONS APPLY REGARDLESS OF WHETHER THE PARTY LIABLE OR ALLEGEDLY LIABLE WAS ADVISED, HAD OTHER REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT The Ban Exchange (AND ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS), IS NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER, INCLUDING YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF The Ban Exchange (OR ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS) TO YOU EXCEED THE AMOUNT PAID BY YOU TO THE BAN EXCHANGE DURING THE THREE (3) MONTHS PRIOR TO ANY CLAIM OF INJURY OR DAMAGE.
